Yes, you can sell a rented home in Dubai: a fixed-term lease carries on after the sale, and the buyer becomes the landlord. To sell with vacant possession instead, you need the tenant's written agreement to leave, or a 12-month eviction notice served through a notary public or registered post that takes effect no earlier than the end of the lease. This guide to tenanted property Dubai sales covers the seller's three routes, what the buyer takes on, what the tenant keeps and a handover checklist.

  • The lease survives the sale: under Article 28 of Law No. 26 of 2007, a change of owner doesn't affect the tenant's right to stay under a fixed-term lease signed with the previous owner.
  • The buyer becomes the landlord: the law, as amended by Law No. 33 of 2008, defines a landlord to include anyone to whom ownership passes during the lease.
  • No early exit by one side: a valid lease can only end before its term by mutual consent or as the law allows (Article 7).
  • Selling vacant takes 12 months' notice: eviction because the owner wishes to sell is possible only when the lease expires, with notice 12 months before the eviction date (Article 25(2)).
  • Rent changes wait for renewal: the rent can be reviewed only at renewal, with 90 days' notice and within the Real Estate Regulatory Agency (RERA) rent increase rules.

Can you sell a property with a tenant in Dubai?

Yes. Dubai's tenancy law doesn't stop an owner selling a rented home, and the sale doesn't end the lease. Article 28 of Law No. 26 of 2007 says a transfer of ownership doesn't affect the tenant's right to stay under a fixed-term lease, so the buyer takes the property with the tenant and the remaining term.

Law No. 33 of 2008, which amended the 2007 law, counts as landlord anyone to whom ownership is transferred during the lease. From transfer, the buyer has the landlord's rights, such as collecting rent, and duties: maintenance unless the contract says otherwise (Article 16) and refunding the security deposit, or what remains of it, when the lease ends (Article 20).

The sale itself follows the usual steps in our guides to documents required to sell and the cost of selling. Dubai Land Department (DLD) registers the transfer at a Real Estate Registration Trustee centre or through Dubai Now, and for freehold homes it needs the developer's electronic no-objection certificate.

What are a seller's options with a tenant in place?

A seller has three routes: sell with the tenant and the lease, give 12 months' notice and sell vacant once the lease expires, or agree an earlier exit with the tenant in writing. Which one fits depends on how long the lease has left to run and on who you want to sell to.

RouteHow it worksTimingBuyers it suits
Sell with the tenantThe lease continues; the buyer becomes the landlord and takes over the rent, the deposit and the remaining termAs soon as you find a buyerInvestors who want rental income from day one
Sell vacant at lease endNotice that the owner wishes to sell, served through a notary public or registered post; eviction only from the lease's expiryAt least 12 months from the notice, and not before the lease endsBuyers who want to live in the home or relet it on new terms
Agree an early exitThe tenant agrees in writing to leave on a set date, on terms you negotiateWhenever both sides agreeAny buyer, once the date is fixed

The law is precise about the notice for the second route. Article 25(2)(d) lets a landlord seek eviction when the lease expires if the owner wishes to sell, provided the tenant is told the reason 12 months before the eviction date through a notary public or by registered post. Those are the only two methods named, so an email or a text message on its own doesn't meet it.

The eviction date must be at least 12 months after the notice and no earlier than the lease expiry. If a tenant doesn't leave, the landlord files an eviction claim with the Rental Disputes Center (RDC). The RDC asks for the notarised notice with the notification officer's report, or the registered post receipt with the acknowledgement, and the filing fee is 3.5% of the annual rent, at least AED 500 and at most AED 20,000, plus small fixed fees. All documents must be in Arabic or legally translated.

Notices served before a sale The law doesn't spell out whether a buyer can rely on a 12-month notice the seller served. If vacant possession matters to the deal, make it a written condition of the sale contract, keep proof of how and when the notice was served, and take legal advice. This guide is general information, not legal advice.

Can the new owner evict the tenant?

Not just because they bought the property. During a fixed-term lease neither side can end it alone, and the buyer inherits that lease. When it expires, the new owner can seek eviction only on the grounds in Article 25(2), such as needing the home for personal use or for a first-degree relative, with 12 months' notice through a notary public or registered post.

Each ground has conditions. For personal use, the owner must prove they don't own another suitable property, and a home recovered that way can't be let to someone else for two years if residential, unless the tribunal (today the RDC) sets a shorter period (Article 26). Before the lease ends, eviction is possible only for the breaches in Article 25(1), such as rent unpaid 30 days after a notice to pay. Our guide to Dubai tenancy laws covers each ground.

What does a buyer of a tenanted property take on?

The lease exactly as it stands: the tenant, the rent, the remaining term, the payment schedule and the security deposit the tenant paid. You can't change the rent until renewal, and then only with at least 90 days' notice before the lease expires (unless the contract says otherwise) and within the rent increase rules set by Decree No. 43 of 2013.

Before you commit, ask for the tenancy contract and its Ejari registration (Article 4(2) requires every lease and amendment to be registered with RERA), the record of rent paid, the deposit amount and any notices served by either side. Check the rent against DLD's Rental Index, work out the return with our guide to true rental yield, and see what the rent could do at renewal with our RERA rent increase calculator guide.

A payment plan written into the lease, including monthly or quarterly instalments agreed under DLD's Flexi Rent initiative, is part of the tenancy contract, so it carries on too. If you are financing the purchase, the Central Bank of the UAE (CBUAE) caps an investment-property mortgage at 60% of the property's value for expatriates and 65% for UAE nationals; our guide to the EIBOR rate explains how the loan rate moves.

The law sets who is landlord; it doesn't set how rent, cheques and the deposit change hands. Agree these points with the other side and write them into the sale agreement (Form F). Items marked "practice" are common market arrangements, not legal requirements.

What happens to the tenant when the home is sold?

Very little changes for a tenant on a fixed-term lease. The rent, the term and the payment dates stay the same, the new owner becomes your landlord, and you can't be required to leave before the lease ends. Ask both owners to confirm in writing whom to pay from which date.

If the seller wants the home empty, you are entitled to 12 months' notice through a notary public or registered post, ending no earlier than your lease. You can agree to leave sooner, on terms you negotiate, but only in writing and only if you choose to. Disputes go to the Rental Disputes Center.

Frequently asked questions

Can I sell my property in Dubai with a tenant in it?

Yes. Article 28 of Law No. 26 of 2007 says a change of owner doesn't affect the tenant's right to stay under a fixed-term lease. The lease continues on the same terms and the buyer becomes the landlord.

Can the new owner evict the tenant?

Not during the lease. At expiry, the new owner can seek eviction only on a ground in Article 25(2), such as personal use, with 12 months' notice through a notary public or registered post.

How much notice is needed to sell a rented property with vacant possession?

Twelve months before the eviction date, served through a notary public or registered post, and the eviction can't take effect before the lease expires. A tenant can also agree in writing to leave earlier.

Who gets the security deposit when a rented property is sold?

The landlord must refund the deposit, or what remains, when the lease ends (Article 20). As the buyer becomes the landlord, the deposit is normally transferred to the buyer at the sale.

Can the new owner increase the rent?

Only at renewal, with at least 90 days' notice before the lease expires, and within the increase allowed by Decree No. 43 of 2013 and DLD's Rental Index.

Does the Ejari change when a property is sold?

The registration needs updating, because Article 4(2) requires every tenancy contract and every amendment to be registered with RERA. Ask your trustee centre or property manager which Ejari service applies.
